45 days or less in IDOC then sent home?

Husband has court tomorrow on his bday January 19th His sentence is one year 180 days, he has completed  134 days on EHM, his lawyer told me that he would be going to prison tomorrow to finish his 46 days. Does that even make sense? Has anybody LO ever been to Idoc for less than that time just to finish out they're sentence? What about the 61 day Rule? That can't be possible if he only has 46 days left to complete.  I'm confused this is for a driving on suspended charge  2 conviction. Non violent history just driving

How did it turn out?  We are in the same situation now.  Just curious.
